Privacy Policy Smallegange Advocaten

Smallegange N.V. (hereinafter referred to as “Smallegange Lawyers” or “we”) takes care of your personal data in accordance with the new privacy legislation, the General Data Protection Regulation (hereinafter referred to as the “GDPR”). This means that you can count on the personal information provided to us or otherwise obtained by us being treated confidentially.

The Privacy policy below implements the information obligation laid down in the GDPR to the data subject(s) whose personal data Smallegange Lawyers processes. This Privacy policy was recently updated on 1 June 2018 and we reserve the right to unilaterally change or supplement this notice. In the event of major changes in this regard, you will be informed about this via the website. Therefore, consult our website regularly.

Personal data

Personal data refers to all information about an identified or identifiable natural person. Smallegange Lawyers processes the following personal data for the purpose of providing services or which have been provided by the data subject on their own initiative:

  • first and last name, prefix, title;
  • contact details such as your e-mail address, postal address and telephone number;
  • data concerning your visit to our website;
  • personal data that you provide to us in the context of attending our events or meetings;
  • all other personal data relating to you in connection with the purposes and on the basis of the principles as stated below

Smallegange Lawyers processes the aforementioned personal data because they have been provided by you as the data subject on your own initiative, have been obtained in the context of providing services, have been made known to us by third parties. Such as via counterparties, the Chamber of Commerce or which have become known to us via public sources.

Purpose of processing

Smallegange Lawyers processes personal data in order to be able to offer services and improve our services and to be able to communicate with you personally as the data subject. Smallegange Lawyers processes the personal data mentioned below exclusively for the purposes mentioned below:

  • providing legal services, including the execution of an agreement and conducting (legal) proceedings
  • advice, mediation and referral
  • meeting our legal and statutory obligations
  • collecting invoices
  • keeping statistics regarding the use of our website and/or to analyse and improve the website
  • marketing and communication activities, for example the Smallegange Lawyers newsletter and our events
  • recruitment and selection

Basis for processing

Smallegange Lawyers processes the personal data mentioned above exclusively on the basis of the grounds mentioned below as referred to in article 6 of the GDPR:

  • execution of an agreement
  • obtained consent from data subject(s)
  • legitimate interest

Sharing with third parties

Smallegange Lawyers only shares your personal data with third parties to the extent necessary for the provision of services in compliance with the purposes mentioned above. For example, engaging a third party on behalf of and by order of Smallegange Lawyers, such as an IT supplier, but also providing your personal data in connection with (legal) proceedings or correspondence with the other party.

In addition, Smallegange Lawyers may provide personal data to a third party, such as a supervisory authority or another body vested with public authority, to the extent that there is a legal obligation to do so.

A processing agreement is concluded with the third party that processes your personal data on behalf of and on the instructions of Smallegange Lawyers, whereby that third party is also obliged to comply with the GDPR. Third parties engaged by Smallegange Lawyers, who offer services as a controller, are themselves responsible for compliance with the GDPR for the (further) processing of your personal data. This includes an accountant, notary or other third party engaged, for example for an expert report.

In order to be able to offer our services, it may be necessary for us to transfer your personal data to a recipient in a country outside the European Economic Area. In that case, Smallegange Lawyers will ensure that such transfer of data is in accordance with the applicable laws and regulations.
Security

Smallegange Lawyers will ensure the security and protection of your personal data, taking into account the state of the art. We will take appropriate and organizational measures to guarantee a level of security that is appropriate to the risk. When third parties are involved, such as an IT supplier, Smallegange Lawyers will record agreements on adequate security measures in a processing agreement within the framework of the protection of personal data.

Retention period

Smallegange Lawyers does not store your personal data for longer than is strictly necessary to achieve the purposes for which your data was provided to us, or as required by law and regulations.
Your privacy rights

You can send a request for access, correction, limitation, objection, transferability of your personal data or withdrawal of previously given consent via the contact details below. You will receive further notice from us within four weeks of receipt of your request.

However, circumstances may arise in which Smallegange Lawyers cannot or cannot fully implement your request. This includes the confidentiality obligation of lawyers and statutory retention periods.
