LITIGATION & ARBITRATION

Majority of the cases we handle involve dispute resolution. Mostly with regards to collisions, cargo damage, cargo thefts and other contractual disputes. Assistance may range from merely advising on the legal position, to negotiating an out-of-court settlement or if necessary, litigation. Smallegange's lawyers are highly experienced in conducting all types of legal proceedings, both in the state courts and in arbitration. Among other things, we are adept at ship arrest, the attachment of other assets, litigating in state court proceedings, declaratory actions, and conducting arbitrations (at the various arbitration institutions, such as UNUM, NAI and Fenex).

Furthermore we also regularly issue second opinions, both in ongoing cases and on a possible appeal after a first instance ruling. We also assist clients in conducting legal proceedings outside the Netherlands, by engaging foreign lawyers.
